If you do not agree to these terms, you must immediately cease all use of this digital infrastructure. 

1. Scope of Digital Content & Advisory Limitation

All content, frameworks, and methodologies provided on this public-facing domain are for general corporate and informational purposes only. The presentation of this information does not establish a formal consulting, engineering, or advisory relationship. Binding Enterprise Risk Management, ISO 31000 compliance auditing, and Life-Safety architecture services are rendered strictly under a fully executed Master Services Agreement (MSA).

2. Intellectual Property & Proprietary Frameworks

All risk matrices, hazardous area classification methodologies (including ATEX and OSHA Process Safety Management rubrics), text, graphics, logos, and digital architecture displayed on this site are the exclusive intellectual property of Emberstone Global Risk LLC. Unauthorized reproduction, reverse-engineering, distribution, or reliance upon these materials without explicit written consent is strictly prohibited and subject to civil prosecution.

3. Limitation of Liability & Third-Party Execution

Emberstone Global Risk LLC operates exclusively as an independent risk architecture and advisory firm. We formally disclaim any and all liability for operational, mechanical, structural, or life-safety deviations resulting from the construction, installation, or alteration activities executed by third-party general contractors, subcontractors, or localized engineering firms. Emberstone shall not be held liable for any indirect, consequential, or punitive damages, including but not limited to loss of tax equity, operational suspension, or regulatory fines incurred by third-party entities.

4. Secure Portal Access & Authentication

Access to the Emberstone Secure Client Portal is strictly restricted to authorized executives under an active MSA and Non-Disclosure Agreement (NDA). Unauthorized attempts to bypass authentication, probe system architecture, or access proprietary client vaults violate federal statutes, including the Computer Fraud and Abuse Act (CFAA). All unauthorized authentication attempts are systematically logged, flagged, and escalated.

1. Information Collection & IP Logging

To maintain the integrity of our enterprise architecture, Emberstone utilizes active threat-monitoring protocols. When you access this site or the Secure Client Portal, our servers automatically log standard diagnostic data, including your Internet Protocol (IP) address, browser type, authentication tokens, and access timestamps.

2. Use of Corporate Information

Information submitted through secure channels, risk inquiry forms, or portal authentication requests is utilized exclusively for:

• Verifying corporate identity and managing authorization credentials.
• Establishing secure communications regarding Enterprise Risk Management and Compliance Audits.
• Protecting our digital infrastructure against unauthorized intrusion or industrial espionage.

3. Data Security & ISO 27001 Alignment

Emberstone employs enterprise-grade encryption, secure server architecture, and stringent access controls aligned with ISO 27001 standards to protect corporate data. We do not sell, trade, or distribute client data or digital footprints to commercial third parties or marketing entities.

4. Mandatory Regulatory Disclosures (Duty to Warn)

While we maintain the highest standards of corporate confidentiality, Emberstone Global Risk LLC is bound by strict engineering ethics, including the National Institute for Certification in Engineering Technologies (NICET) Code of Ethics, and federal statutes such as OSHA 29 CFR 1910.119. We expressly reserve the right to disclose necessary information, communications, or site data to the Authority Having Jurisdiction (AHJ), State Fire Marshals, or federal regulatory bodies if we identify an undisclosed, imminent, or systemic threat to public safety, life-safety compliance, or hazardous/explosive material containment.

5. Governing Law & Jurisdiction

These Terms of Service and Privacy Policy shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising under or relating to these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
